The UK Smoking ban was introduced in The Health Act 2006: Chapter 28, Part 1, Chapter 1, Section 1, Para 2 of the act states:
"Smoking" refers to smoking tobacco or anything which contains tobacco, or smoking any substance; and smoking includes being in possession of lit tobacco or of anything lit which contains tobacco, or being in possession of any other lit substance in a form in which it could be smoked.
Therefore, electronic smoking products such as E-Cigarettes are exempt from this legislation because no tobacco is lit or used!
